What is a First-Time DWI?
DWI stands for “driving while intoxicated.” It is a crime to operate a motor vehicle while under the influence of alcohol or drugs, or with a blood alcohol concentration (BAC) of .08% or higher. This is true regardless of whether your ability to drive was impaired.
In New York, a first-time DWI is a misdemeanor. If convicted, you can face the following penalties:
- Up to 1 year in jail
- Up to $1,000 in fines
- License suspension for 6 months
- 1 year of probation
- Required installation of an ignition interlock device (IID) for 1 year
However, if your BAC is at least .18 percent or higher, you can be charged with Aggravated DWI, punishable by increased penalties, such as fines of up to $2,500 and license revocation for at least one year. If your BAC is more than .05 but less than .07 percent, you can be charged with driving while ability impaired (DWAI) by alcohol, which carries a maximum jail term of 15 days, a fine of up to $500, and license suspension for 90 days.
