Law 360: NY Atty, Doctor Get Bail Extension Amid Trip-And-Fall Appeal

U.S. District Judge Sidney H. Stein said in an order that the appeals by George Constantine and Dr. Andrew Dowd raised questions of law substantial enough to show they were not filed to merely delay things.

"Defendants have raised a gallimaufry of evidentiary issues," the judge wrote. ..

The judge also said he could "easily conclude by clear and convincing evidence" that neither Constantine nor Dowd were likely to flee or pose a danger to anyone if they were allowed to remain out on bail.

... "We believe that the decision continuing Mr. Constantine's bail is fair and correct in view of his background and the significant issues presented, and we are looking forward to appealing his conviction," said Constantine's attorney Donna Aldea of Barket Epstein Kearon Aldea & LoTurco LLP.
