Our Huntington-based partner, John LoTurco, recently successfully litigated a hotly contested assault trial at the Suffolk County District Court whereby our client was acquitted on the theory of a justification defense after a two-week trial before the Honorable Pierce Cohalan.
The defense had to overcome video evidence of our client punching the defendant in the face which caused the complainant a fractured jaw. Our client credibly testified that the video did not show that the complainant had thrown the first punch and that he was acting in self-defense and had no intent to injure the complainant, but rather was only protecting himself from serious bodily injury.
