People v. Ramrup Motion Papers and Decision

Dear Friends and Colleagues,

I am happy and proud to share with you all that Rudolph Ramrup was found not guilty of the felony DWI charge after trial in Bronx County Supreme Court. Many of you have followed this case which we litigated for the past four years. The discovery motions resulted in the decision by Judge Price which mandated disclosure by the People of the actual gas chromatograms used when certifying the simulator solution used in a DWI arrest and breath test of a motorist. The consequence of the discovery failure was the preclusion of the breath test evidence. This result confirms that “that is the way it’s done” is not an acceptable practice. I am happy to share the motion to compel with any of you who wish to incorporate it into your practice.
